Azerbaijan includes removal of children from parents who pose a threat to their health, in the list of state responsibilities

Responsibilities of the state are increased concerning domestic violence that is not investigated in the manner established by criminal procedural legislation in Azerbaijan, it was reflected in the proposed amendment to the ‘On the prevention of domestic violence’ law, which was discussed at today’s meeting of Milli Majlis (Azerbaijani Parliament). According to the proposed amendment, taking measurements on the protection of the rights and legal interests of minors affected by domestic violence, as well as, if there are the reasons defined by Article 72 of the Family Code of the Republic of Azerbaijan (taking a child away from parents (or persons replacing them) when there is a direct threat to the child’s health or life), urgently taking the child from the parents (one of them) or from the persons who have taken them under guardianship are included in the list of state’s duties.

At the same time, according to the draft law, assisting in restoring family relations is excluded from the duties o
f the state regarding domestic violence that is not investigated in the manner determined by the criminal-procedural legislation.

The state must ensure the monitoring and coordination of the measures provided by this law on the prevention of domestic violence. It was noted that, even though it is considered appropriate for the state authorities to help to normalize the relations of the parties in a general sense, restoring relations in the family should be based on the family members’ own choice and personal conclusions.

The draft law was put into a vote and was approved on first reading.
