Azerbaijan Announces Amnesty Categories Exempting Grave Crime Convictions

Baku: Azerbaijan’s Milli Majlis has declared an amnesty, exempting certain categories of individuals from imprisonment regardless of sentence length. This parliamentary decision, part of the ‘Year of Constitution and Sovereignty’, excludes those convicted of grave and especially grave crimes. The announcement details specific groups eligible for release, aiming to address various humanitarian and historical considerations.

According to Azeri-Press News Agency, the amnesty will apply to individuals who participated in military operations defending Azerbaijan’s sovereignty and territorial integrity. This includes participants in the Patriotic War and recent anti-terrorist operations, as well as their close relatives who suffered loss or injury. Also eligible are those awarded honors in service to the nation, barring individuals stripped of such awards by law.

Further categories include those disabled or with relatives affected by Armenian military provocations, individuals affected by historic ethnic cleansing and deportations, and those displaced by territorial occupations. Persons affected by the January 20, 1990 events, political repression during the USSR era, and the Chernobyl disaster are also included. Women, minors at the time of offense, seniors, the disabled, and individuals with dependent children qualify as well.

The amnesty initiative, proposed by President Ilham Aliyev, also considers individuals convicted of lesser offenses. Those sentenced for crimes posing no significant public danger, or for negligence or less serious crimes with minimal sentences remaining, will benefit. The initiative extends to various forms of non-custodial sentences and fines.

With these measures, Azerbaijan’s government seeks to foster a spirit of reconciliation and humanitarian relief, while maintaining legal distinctions for grave offenses. The amnesty will be implemented by relevant judicial and investigative bodies, ensuring that qualifying individuals are granted relief as intended.
