The bill on housing and communal services considered in the Senate


The Committee on Economic Policy, Innovative Development and Entrepreneurship considered the draft Law of the Republic of Kazakhstan On Amendments and Additions to Some Legislative Acts of the Republic of Kazakhstan on Housing and Communal Services.

The bill was developed to improve legislation in the field of housing and communal services.

The document introduces amendments and additions to a number of legislative acts.

The draft law proposes a new model for managing a condominium property by creating the non-profit organization Association of Property Owners on the principle of one house – one association of property owners (hereinafter referred to as OSI).

A mechanism is introduced for financing capital repairs of the common property of a condominium object, which is based on the accumulation of funds by owners of residential and non-residential premises and a loan from a second-tier bank. At the same time, in payments to second-tier banks on unfulfilled obligations by the borrower as part of a housing loan received for the purpose of overhauling a condominium object, they will be carried out by a specialized fund for guaranteeing overhaul.

The draft Law proposes norms aimed at increasing the transparency of the management bodies and ensuring control by the owners of the premises over the management body of the condominium object, as well as improving the interaction between the subjects of housing legal relations.

Along with this, the bill establishes the procedure for the formation, implementation and termination of the activities of a housing and construction cooperative, membership conditions and the contents of the charter.

The norms are regulated in terms of licensing the exploration of solid minerals in relation to incomplete (partial) blocks, permits for the exploration or production of common minerals, and the size of the annual minimum costs for mining operations is also reduced.

In addition, under the bill, restrictions are set on foreign participation (control) in airlines created in the form of a joint stock company.
