Outdoor advertising facilities and advertising to be regulated separately


The plenary session of the Majilis of the Parliament of the Republic of Kazakhstan approved in the first reading the bill “On Amendments and Additions to Certain Legislative Acts of the Republic of Kazakhstan on Advertising”.

The bill provides for the following. For the first time, the advertising sector has defined an authorized body � the Ministry of National Economy, and regulatory state bodies � Ministries of Information and Communications, Investment and Development, Internal Affairs, Healthcare. Given the variety of regulated legal relations, we decided, in accordance with the laws “On Permits and Notifications” and “On Self-Regulation”, to determine the authorized and regulatory state bodies in the field of advertising.

The authorized body will carry out management and intersectoral coordination on advertising issues and approve the standard rules for the placement of outdoor advertising. The regulatory bodies will administer individual sectors � the media, roads, road safety, medicines, biologically active additives and medical equipment, which involve advertising activity. The concept of “outdoor advertising facilities” is introduced, which covers all facilities and other means where advertising can be placed and distributed today, given the dynamic development of the advertising market, � Minister of National Economy Timur Suleimenov said presenting the bill.

The Minister explained that the working group’s discussions resulted in the proposal of separate regulation of outdoor advertising facilities and advertising itself. Outdoor advertising will be regulated by the Law “On Advertising” and the rules for placing outdoor advertising. Outdoor advertising facilities will be regulated by the Land Code and legislation on architectural, town-planning and construction activities, roads and traffic.

T. Suleimenov also said that the bill establishes administrative responsibility for violating the legislation in the field of advertising. Given the current policy on dedollarization of the economy, administrative responsibility has been introduced for failing to indicate the price of goods in the national currency, when it is sold on the territory of the Republic of Kazakhstan.

The Minister noted that the bill defines a mechanism for the distribution of social advertising on television and radio channels. It is proposed to establish a daily volume of social advertising. Social advertising will be placed on the compulsory 15 TV and radio channels; the list of compulsory channels is approved by order of the MIC of April 13, 2016 No. 368. The daily volume of social advertising is at least 10 broadcasts from 6:00 to 24:00, while 2 broadcasts will be required during prime time. Social advertising on compulsory 15 TV, radio channels will be placed free of charge.
