Illegal use of trademark to be compensated

Considered today at the Government meeting draft law on the intellectual property, presented by the Minister of Justice Marat Beketayev, provides rules aimed at receiving by the copyright holders the compensation for the illegal use of a trademark.

The Law On Copyright provides the authors right to recover the compensation for the illegal use of work of authorship. Meanwhile, the trademark owner does not have such a right, the Minister said.

In this regard, the amendments to the Civil Code provides the right of a trademark owner to claim compensation from the infringer instead of recovery of losses in the established by the court amount of 500-10,000 MCI or twice the amount of the value of goods, which the trademark is illegally placed on.

The bill On amendments and additions to some legislative acts of the Republic of Kazakhstan on improving the intellectual property legislation is aimed at removing the intellectual property barriers.
