About the effectiveness of a pilot project for consideration of labor disputes
Pilot project “Prevention of labor conflicts and disputes arising out of public relations” is implemented in the Baikonur district court, Esil district and Specialized inter-district economic courts.
This project is aimed at reducing conflicts in labor collectives. For this purpose organizations and enterprises of the city are working on explanation of labor relations in the framework of this project.
The outcomes of the events show the success of the project. For example, in the first quarter of this year, 296 cases of labor disputes were considered, which is less than in the first quarter of 2018 7 cases.
Out of 331 filed complaints, 55 were withdrawn due to dispute settlement procedures.
As a result of cooperation of regional courts with state inspectors on labor protection and restoration of violated rights, 52 claims were left unattended.
In order to successfully implement the pilot project, Astana will invite and advise the parties in the district courts after the registration of the suit and the civil case (in accordance with Part 1 of Article 155 of the Code of the Republic of Kazakhstan five working days). This work will continue after the civil case is initiated. Due to the number of completed cases, the cessation of proceedings on 47 cases (16%) (in 2018 31 cases or 11%) is a result of such activities.
Thus, according to the results of the explanatory work, 52 claims were left without consideration by the state labor inspector. With the participation of a mediator and mediation mediator and a lawyer of the LEGAL-SYSTEM Legal Consultants Chamber, the LLP will pay 9,800,000 Tenge in arrears of 29 employees. Under the supervision of the Astana City Supervision and Quality Control Department, the rights of 951 employees were pre-trial, and 44.4 million wages were paid. Tenge was repaid in tenge.
